TO THE EXTENT PERMITTED BY LAW, THIS 1 YEAR WARRANTY AND REMEDIES SET FORTH ABOVE ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL OR WRITTEN, STATUTORY, EXPRESS OR IMPLIED. AS PERMITTED BY APPLICABLE LAW, THIS 1 YEAR WARRANTY SPECIFICALLY DISCLAIMS ANY AND ALL STATUTORY OR IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND WARRANTIES AGAINST HIDDEN OR LATENT DEFECTS. IF CANNOT LAWFULLY DISCLAIM STATUTORY OR IMPLIED WARRANTIES THEN TO THE EXTENT PERMITTED BY LAW, ALL SUCH WARRANTIES SHALL BE LIMITED IN DURATION TO THE DURATION OF THIS EXPRESS 1 YEAR WARRANTY AND TO REPAIR OR REPLACEMENT SERVICE AS DETERMINED AT OLY’S SOLE DISCRETION. OLY RESERVES THE RIGHT TO CHANGE 1 YEAR WARRANTY AT ANY TIME.
No other reseller, agent, or employee is authorized to make any modification, extension, or addition to this 1 year warranty. If any term is held to be illegal or unenforceable, the legality or enforceability of the remaining terms shall not be affected or impaired.
Note: All warranties apply to the original owner only, and begin at the date of purchase. Proof of purchase is required with all 1 year warranty claims.
Frame (Metal, Wood or Resin)
Structural frames for beds, tables, seating, etc. come with a limited structural 1 year warranty when properly maintained in ordinary home use. Furniture that has failed structurally during normal use and regular maintenance will, at company option, be repaired or replaced.
Finish
There is a 1 year limited warranty against blistering or peeling of the frame finish under normal use and proper maintenance. The furniture will, at company option, be refinished or replaced if either of the above occurs within limited time period from the date of purchase. Occasional rust seepage from crevices and hidden unfinished surfaces inherent in some designs is considered a care and maintenance function and is not considered a finish failure.
Resin
NOTE: All Oly resins are durable and suitable for daily use, as regards the rustic resin particular it is slightly more porous than our other resin finishes (e.g. gloss black or gloss white) and as such should be treated the same way you would treat a non-sealed stone surface. While the surface does not stain particularly easily, we would always recommend the use of placemats/coasters and all spills should be cleaned immediately. The rustic resins are designed to patina and mature with use and that should add to the beauty of the piece, clients should be aware that the darker finishes (coco and charcoal) are generally more resistant to visually evolving with time. The rustic finishes are not treated, and while clients are welcome to make changes to any of our pieces we do want to remind them that such alterations or treatments would invalidate the warranty and Oly unfortunately can’t be held responsible for how the finish may react. Cleaning is easily done with a clean damp cloth and dried afterwards with a clean cloth.
Granite, Agate, Limestone, Marble
NOTE: Client understands that Granite, Agate, Limestone and Marble are natural stone that is unsealed. It is your responsibility to inform your end client and have them professionally sealed.
Onyx
NOTE: Please note that the onyx used for our goods is natural therefore the stone striation will vary quite a bit. Each piece is unique and we are unable match stone.
Cushions
There is a 1 year limited warranty on all cushions. This extended 1 year warranty covers the quality of the craftsmanship, the construction of the cushion and any fading or discoloration of the fabric, which has been properly maintained as listed in our care and maintenance instructions. If it is determined that the cushions is defective as listed above within a limited time period from the date of purchase, the cushion will, at company option, be repaired or replaced. C.O.M. fabrics are not covered under this 1 year warranty.
Table Tops
There is a 1 year limited warranty on all tops from date of purchase. This 1 year limited warranty covers the workmanship and structural integrity of the top. Tabletops found to be defective during this 1 year warranty period will, at company option, be repaired or replaced. Regular maintenance must be exercised as set forth in the care instructions.
Accessories
There is a 1 year limited warranty on all accessories such as mirrors, case goods, lighting etc. from date of purchase. This 1 year limited warranty covers the workmanship and structural integrity of the accessory. Accessories found to be defective during this 1 year warranty period will, at company option, be repaired or replaced. Regular maintenance must be exercised.In the event the furniture style, finish, fabric or table top has been discontinued, the product will be replaced with a similar item.
This 1 year warranty does not apply to any damage caused by shipping, accidents, natural fading, staining, natural weathering, misuse, alterations or repairs. No other person is authorized to assume liability on behalf of Oly, and in no event shall Oly be liable for any contributory or subsequent damage related to the merchandise purchased from Oly.
Not Covered Under the 1 Year Warranty:
Items with..
1. Any failure caused by unreasonable use or abuse
2. Rust seepage or bleeding from crevices or hidden, non-finished surfaces inherent in some metal designs
3. Rusting and/or oxidation of frames resulting from exposed metals that have been scratched, chipped or not maintained as outlined in the care and maintenance instructions
4. Natural fading or discoloration of fabrics beyond 1 year warranty period
5. C.O.M. fabrics (customer’s own material)
6. Normal fading of frame finish
7. Accidental damage (including fire, wind, dropping or others)
8. Permanent stains caused by lotions, oils or other substances.
9. Hard-water deposits or calcium build-up due to minerals found in regional water supplies
10. Furniture used in commercial or institutional us
11. Damages incurred from shipping, handling and storage
12. Failures drive by inadequate care, upkeep and maintenance
